The “Agency Disclosure" law went into effect on November 25, 1999 in Pennsylvania. This legislation helps consumers by explaining in the beginning of communications who works for whom in a real estate transaction and lets consumers know what options for service are available. Realtors that ask you to sign the Consumer Notice at the beginning of their communications are full-filling the legal requirements under Pennsylvania law. The form is not a legal contract and does not commit the consumer to any relationship with the Realtor.
Before you disclose any information to a licensee, be advised that unless you select an agency relationship the licensee is NOT REPRESENTING YOU. A business relationship of any kind will NOT be presumed but must be established between the consumer and the licensee.
At Miller & Associates Real Estate, LLC, a completed rental application is required prior to viewing available residential rental units. Every adult in the household is required to complete the application. There is no fee charged to the applicant applying for available rentals or for processing applications.

Completed rental applications can be delivered to our office at 914 Fairfield Road in Gettysburg, PA 17325 or by faxing to 717-337-1133. If your timeframe permits you may also US Mail the completed rental application.

We use a standard lease developed by the Pennsylvania Association of REALTORS®. Using a consistent format provides continuity in enforcing terms and conditions for those properties for which we also provide property management services.
The W-9 Form is the Internal Revenue Service form that is used to confirm the taxpayer identification number which in most cases is your social security number. This form is required prior to making payments of interest to tenants. The Landlord Tenant Act in the State of Pennsylvania requires landlords to pay interest on security deposits after the second year of a lease. This form is used so that interest payments can be made and reported appropriately.
By submitting the W-9, you are certifying that the tax identification number you are providing is correct and you are declaring whether or not you are subject to backup withholding of Federal Income Taxes.
For the convenience of tenants, a list of frequently used utility services in the Adams County area are provided to make the move easier. Tenants are to begin utility services in their names no later than the starting date of the lease.
As part of the lead based paint disclosure, every landlord of a property built before 1978 must provide tenants with the brochure “Protect Your Family From Lead in Your Home”.
All agreements for property management and leasing between a landlord and Miller & Associates Real Estate, LLC are required to be in writing. The listing agreement provides the details on the terms which have been established between the Miller & Associates Real Estate, LLC and the landlord. This agreement is required to include details on the duration of the listing agreement, the fees or commissions to be paid, and the scope of the work to be performed.
The Property Description form is a companion form to be included with the Listing for Rent Contract. The description form provides the specific details about the listed property including features, utilities included in the rent and those to be paid by tenant, and other amenities such as appliances which are be included as part of the terms.
This form is designed to assist both the landlord and tenant in recording the condition of a rental unit upon moving in and moving out. To be most useful, it should be filled out in the presence of the property owner and the tenant, and each should retain a signed and dated copy.
